A meeting of the Dighton Water District Commissioners was held at the District office at 6:00 P.M.  Chairman of the Board, Paul Pacheco called the meeting to order. 

 

Commissioner, Edward Swartz said, “I make a motion that we rescind the vote of the Board of Commissioners of June 10, 2008 regarding the boundaries and revert back to the boundaries described at that point.”  Paul Pacheco said, “I’ll step down and second.  All in favor.  The Ayes have it.”  Edward Swartz said, “Based on a legal opinion we received from David Gay I would also secondly make a motion we refer to the Treasurer/Collector work with the assessor to garner the list of those taxes that were paid by those residents between that time we adopted that motion in 2008 and today and we gather that list so we have that for the next meeting.”  Paul Pacheco said, “I’ll step down and second that.  All in favor.  The Ayes have it.”  Edward Swartz said, “Then refer the updating of the Home Rule Petition for a future meeting to meet with David Gay once he returns from vacation I’ll ask the Chairman if he will schedule that meeting.”  Paul Pacheco said, “Okay I’ll schedule it any particular time?”  Edward Swartz said, “No, find David’s schedule morning or evening get dates early September is better.”

 

Edward Swartz said, “I make a motion to approve the minutes.”  Commissioner, Sue Medeiros said, “Second.”  Paul Pacheco said, “All in favor.  Ayes have it.”  Warrants were passed out for review by the Board. 

 

Edward Swartz made reference to refunds and abatements and said,

“None of that can take place until probably the end of October, any kind of payments have to go through Special District Meeting, has to be paid for out of free cash, we have to wait for certification of free cash.”

 

Sue Medeiros said, “I make a motion to approve the warrants.  Edward Swartz said, “Second.”  Paul Pacheco said, “All in favor.  Ayes have it.”

 

Correspondence; Draft regarding 2009 Water System Study Update.  Edward Swartz said, “Refer to the next meeting, meet with Steve just to have him review it with us.”

 

Employee “To Do List”; Paul Pacheco said, “Read them through discuss them at the next meeting.”  Edward Swartz said, “Refer to the next meeting.”  Paul Pacheco said, “Refer to the next meeting.”

 

Signs; Paul Pacheco said, “I met with the guy from Countryside Signs for some ideas and costs.  He mentioned it could cost between $25,000-$30,000.”

 

Update on website;  Treasurer/Clerk, Carol Stevens mentioned, June minutes, Annual, Special, changes in Commissioners and phone numbers were done.  Carol Stevens mentioned letters received from the third graders who took the tour were going to be put on the website.  Edward Swartz said, “Continue every month to send updates in.”  Edward Swartz asked, “Pulling reports out of the new system, end of the month, start pulling next month end of months you can provide to the Commissioners and balances.”

 

Public Input; Edward Swartz said, “For those that arrived late we voted to rescind the vote of June 2008 that extended the boundaries of the District beyond the 2000 feet so it reverts back to where it was prior to and refer to Collector/Treasurer to garner a list in working with the assessor to find out what the cost’s were to those residents from June 2008 to today.  Back to where it was prior to June 2008.  In my opinion we’re going to address that as we go through the new home rule petition based on feedback and comments we got at that Selectmen’s meeting.  My personal opinion, some comments Mr. Carpenter made that night I personally believe we should go all the way back only if it runs by your house for the tax and there should be some type of other fee that covers the overall uses of water of the Town that everyone gets a benefit from $50-$75 that will cover everyone outside of the taxed area up for discussion that’s my opinion right now because everybody does benefit from us having water in Town whether you get it by your house or not whether it’s your kids at school through the fire truck filling the hoses everybody benefits from having water in Town.  Meet with our Attorney to continue that process learned some things on the Somerset agreement piece we didn’t know prior to that have to be addressed so that petition is a working document that probably won’t be submitted for two to three months we’ll have public hearings with it and it’ll be voted on Special or Annual probably won’t go into effect until next fiscal year.” 

 

A review of the vote taken, voting rights, charter, etc… was held with everyone in attendance.  The public gave their input; the Board of Commissioners gave theirs. 

 

Edward Swartz made a motion for a five minutes recess before going into executive session.  Paul Pacheco seconded the motion.

 

Paul Pacheco made a motion to go into executive session for employee issues.  Sue Medeiros seconded the motion.  Sue Medeiros said, “Two minutes, won’t take long.” 

 

In attendance executive session; Paul Pacheco, Edward Swartz, and Sue Medeiros.  Charles Cestodio was called in later on.

 

Executive session ended at 7:50P.M.

 

Carol Stevens gave the Commissioners an update on employee Kevin Carpenter.

 

Sue Medeiros mentioned she would speak to Lenny Hull to set up a meeting with Charles Cestodio.

 

Charles Cestodio reviewed his report with the Commissioners.

 

When Charles Cestodio reached the section Elevated THMS; Edward Swartz said, “Put it on the agenda for next month.  Review elevated THM level plan.”

 

When Charles Cestodio reached the section Cedar Street 1; Edward Swartz said, “Get proposal together what the cost is write an article for Special in October.  Need to reschedule September 15th I will be in Statton Island, New York.  Schedule for the 14th check with Steve.”

 

When Charles Cestodio reached the section Cedar 1 Building in the Rear Needs; Edward Swartz said, “I make a motion Chuck move forward in fixing the Cedar roof needs out of system maintenance if you can do internal, do internal need to go external and get a contractor to do it.  Get three quotes.”

 

When Charles Cestodio reached the section Garage Doors on RT 138; Edward Swartz said, “Repair the doors for the short term to last for the next couple of years.”

 

When Charles Cestodio reached the section Service for 972 Somerset Ave.; Edward Swartz said, “If he gets permission from Jeff Tardinco in writing, wait until next monthly meeting, if he gets permission he has to present it.  Wait until the next meeting if he calls expect him to have a written letter from Jeff Tardinco as well as sign off from all the Town departments that need to sign off on it.  Notify him road opening permit from the State is in if he doesn’t show up September 14th send a letter regarding the road opening permit.” 

 

Edward Swartz said, “I make a motion to adjourn.”  Paul Pacheco said, “Second.”   Meeting adjourned at 8:20 P.M.
